California Is for Everyone: Knowing Your Fair Housing Rights This Pride Month

Every June, Pride Month gives us a chance to celebrate the LGBTQIA+ community and to recommit to the work that makes celebration possible.

At Project Sentinel, that work relates to protecting housing rights under California Fair Housing laws. Because no matter who you are, who you love, or how you express your identity, you have the right to find and keep housing free from discrimination.


This Pride Month, we want to make sure you know what discrimination can look like, what laws protect you, and where to turn if something doesn't feel right.


What Does Housing Discrimination Look Like?

Discrimination based on sex, gender identity, gender expression, or sexual orientation occurs when you are treated differently than other tenants or housing seekers because of any of these characteristics. It can show up as discriminatory statements, different terms or conditions, differential treatment, or even a policy that's applied equally to everyone but disproportionately affects people based on their sex, gender identity, or sexual orientation.


Some warning signs include:

  • Your application is rejected because your gender markers or names don't match across different documents

  • A landlord or agent makes discouraging or stereotyping comments, like "this is more of a quiet family neighborhood"

  • Management asks you not to dress a certain way because your appearance doesn't conform to gender stereotypes

  • A neighbor harasses you because of your gender expression, and the housing provider does nothing

  • You're told a property is no longer available and then you see it still posted online

  • A phone call or showing is abruptly cut short after you mention your sexual orientation or your same-sex partner

  • You're quoted a higher rent or deposit in person than what was listed online

  • A property owner, employee, or neighbor sexually harasses you

 

What Laws Are on Your Side in California?

LGBTQIA+ housing seekers and tenants are protected by state and local laws. The Fair Employment and Housing Act (FEHA) and other civil rights acts under California law explicitly prohibit housing discrimination based on sexual orientation, gender identity, and gender expression.


These protections apply to virtually everyone involved in the sale or rental of housing: owners, property managers and their staff, real estate agents, HOAs, shelters, banks, and mobile home parks. It is illegal for any of them to refuse to rent or sell to you, charge you higher rent or a larger security deposit, steer you toward or away from certain neighborhoods or buildings, evict you, apply different rules or criteria, or harass or threaten you because of a protected characteristic.


It is also illegal for a housing provider to retaliate against you for complaining about discrimination or for contacting a fair housing agency like Project Sentinel.
